Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Firepype LLC ("Firepype," "Company," "we," "us," or "our") governing access to and use of the Firepype website, software, APIs, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

The Service is available only to individuals at least eighteen (18) years of age.

2. Description of Service

Firepype provides a software orchestration platform enabling users to transmit and automate data flows between third-party services. Firepype acts solely as a technical intermediary and does not permanently store user content transmitted between integrated providers.

Firepype does not provide hosting, archival storage, backup services, or financial services.

3. Account Registration and Security

Users must provide accurate and complete registration information.

Users are responsible for safeguarding login credentials and OAuth authorizations and are solely responsible for all activities conducted under their account.

Firepype may suspend or terminate accounts at its discretion for violations of these Terms or for risk mitigation purposes.

4. API Usage and Technical Restrictions

If Firepype provides APIs, automation endpoints, or programmatic access, you agree that you shall not:

• Reverse engineer, decompile, or disassemble the Service
• Circumvent rate limits or technical safeguards
• Use automated systems that generate unreasonable load
• Use the API for resale without written authorization
• Access the Service for competitive analysis
• Attempt to extract source code or proprietary algorithms
• Interfere with security mechanisms

Firepype reserves the right to implement rate limiting, monitoring, throttling, or access revocation to preserve platform integrity.

Unauthorized use may result in immediate termination and legal action.

5. Third-Party Integrations

The Service integrates with third-party platforms including Google, Microsoft, Dropbox, Slack, and others.

Firepype does not control or assume responsibility for third-party services. All use of such services is governed by their respective terms.

Firepype shall not be liable for service outages, API changes, data loss, or disruptions caused by third-party providers.

6. Advertising

The Service may display third-party advertisements. Firepype does not endorse or guarantee advertised products or services and is not responsible for advertiser conduct.

7. Acceptable Use

You agree not to:

• Violate applicable laws or regulations
• Infringe intellectual property rights
• Transmit unlawful, harmful, or malicious content
• Engage in security testing without authorization
• Use the Service for spam, fraud, or abuse

Firepype reserves full discretion to investigate and take corrective action.

8. Service Level and Availability

The Service is provided on an "as is" and "as available" basis.

Firepype does not guarantee uninterrupted availability.

For enterprise customers with a separately executed written agreement, Service Level commitments, if any, shall be governed exclusively by that agreement.

Unless otherwise agreed in writing, Firepype does not provide:

• Uptime guarantees
• Financial credits for downtime
• Dedicated support response times

Maintenance windows and emergency outages may occur without prior notice.

9. Disclaimer of Warranties

To the maximum extent permitted by law, Firepype disclaims all warranties, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy
• Availability
• Reliability

Firepype does not warrant that the Service will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the fullest extent permitted by law:

Firepype LLC shall not be liable for indirect, incidental, consequential, punitive, special, or exemplary damages, including loss of profits, data, business opportunities, or goodwill.

Firepype's total aggregate liability arising from or related to the Service shall not exceed the greater of:

• One hundred U.S. dollars (USD $100), or
• The amount paid by you to Firepype in the preceding twelve (12) months

This limitation applies regardless of theory of liability.

11. Indemnification

You agree to indemnify and hold harmless Firepype LLC and its officers, members, employees, and agents from any claims, liabilities, damages, and expenses arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Your misuse of integrated APIs

12. Export Compliance

The Service may be subject to United States export control laws and regulations.

You represent and warrant that:

• You are not located in a country subject to U.S. embargo
• You are not listed on any U.S. government restricted party list
• You will not use the Service in violation of export laws

You agree to comply with all applicable export control regulations.

13. Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

The arbitration shall take place in Texas unless otherwise agreed. Judgment on the award may be entered in any court of competent jurisdiction.

Each party shall bear its own legal fees unless otherwise required by law.

14. Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis only.

You expressly waive the right to participate in class actions, collective actions, representative actions, or consolidated proceedings.

15. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

16. Force Majeure

Firepype shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, governmental actions, cyberattacks, labor disputes, infrastructure failures, or third-party outages.

17. Assignment

You may not assign these Terms without prior written consent. Firepype may assign these Terms in connection with merger, acquisition, asset sale, or corporate restructuring.

18. Severability

If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.

19. Survival

Sections relating to limitation of liability, indemnification, arbitration, export compliance, governing law, and any other provisions which by their nature should survive termination shall survive.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Firepype LLC regarding the Service.
